Apple Throws a Tantrum After Being Ordered to Tell Samsung Their HTC Secrets

The legal war between Samsung and Apple is going really well and they're both behaving like civil, reasonable adults. Ha, no, not really. Apple just threw a tantrum because they were ordered to tell Samsung a bunch of secrets that could potentially help Samsung keep their products on the shelves.
On Thursday, a judge ordered Apple to hand over informationabout their patent deal with HTC to Samsung. Samsung wants to see the patent agreement between HTC and Apple because it could potentially help their defense in Apple's crusade to get most of Samsung's biggest products taken off store shelves. The Verge's Bryan Bishop explained it best: 
If so, the company argues, Apple's request that infringing Samsung products be removed from the market falls apart, because Apple was happy to "forego exclusivity in exchange for money" — and in this instance, Apple is already receiving money in the form of a hefty $1.049 billion verdict.
So, most likely in response to that judge's ruling, Apple added a bunch of new products to thenever-ending list of Samsung things they want taken off store shelves for infringing on their patents. The new list includes the following: 
  • Samsung's Galaxy S III running the latest Android software (which recently passed the iPhone in global dominance)
  • Samsung's Galaxy Note 2
  • Samsung's Galaxy Tab 8.9 Wifi
  • Samsung's Galaxy Tab 2 10.1
  • Samsung's Rugby Pro
  • Samsung's Galaxy S III Mini
This is just another chapter in the totally mature, totally civil legal battle between the two companies. It will get uglier before it's resolved, we can promise you that.

Samsung wins preliminary round over Apple patent

WASHINGTON (Reuters) - Samsung Electronics Co Ltd, which is battling Apple Inc across the globe for dominance of the smartphone market, dealt the California company a setback by winning a preliminary invalidation of a key Apple patent, according to a court filing.
The fight is related to Apple's war against Google, whose Android software powers many of Samsung's devices.
Samsung said in a filing late Monday that examiners at the U.S. Patent and Trademark Office (PTO) had taken a second look at an Apple patent and decided that it should not have been granted. The patent allows a user with a touch screen to bounce back to the image on the screen if the user goes beyond the edge.
The patent was one of six that Samsung was found to have infringed by a jury in a California federal court in August. It awarded Apple $1.05 billion in damages.
The case is being appealed, and Samsung is pursuing other challenges such as requests for the PTO to reexamine the patent.
Scott Daniels, a litigation partner at Westerman, Hattori, Daniels & Adrian LLP who is not part of the case, said the PTO's preliminary invalidation is not the end of the battle over this specific patent.
He said the patent remains valid through the appeals process.
The case in U.S. District Court, Northern District of California, is Apple Inc v. Samsung Electronics Co Ltd et al, No. 11-1846.

Samsung motions to add iPhone 5 to patent case

SEOUL, South Korea (AP) — South Korea's Samsung Electronics Co. says it has filed a motion with a U.S. court to add Apple's iPhone 5 to their ongoing patent battle.
Samsung says it filed the motion Monday with the California court, alleging that Apple's new phone infringes on eight of its patents.
The two companies are locked in a struggle for supremacy in the global smartphone market, leading to legal cases in courts across the globe.
Samsung released a statement Tuesday saying, "We have always preferred to compete in the marketplace with our innovative products, rather than in courtrooms. However, Apple continues to take aggressive legal measures that will limit market competition."
It said it had "little choice but to take the steps necessary to protect our innovations and intellectual property rights."

Now that some iPhone 5 owners have had their hands on the gadget for a little over a week the ravings have subsided and we're starting to hear more about the phone's flaws and glitches. Beyond the Maps app problems, which Apple continues to say will get better, and other , the phone itself isn't perfect either. Luckily, from what we found on the Apple forums and elsewhere, it looks like most of these problems have a reasonable fix.

Verizon Data Suck 

Issue: iPhone 5 users on the Verizon network have complained that their phone uses data when connected to WiFi, which could lead to huge overage bills. "I somehow managed to burn up 1.8gb of data over 5 days on my iphone 5," one Apple user wrote on a . "This had never happened in my past 4 years of owning an iPhone ... I can't believe I'm about to hit my full months data limit in 6 days when I connected to wifi 75% of the day."

Fix: Verizon has acknowledged that there is in fact a bug, reassuring users that they will not be charged for the extra usage. "Under certain circumstances, iPhone 5 may use Verizon cellular data while the phone is connected to a Wi-Fi network. Apple has a fix that is being delivered to Verizon customers right on their iPhone 5. Verizon Wireless customers will not be charged for any unwarranted cellular data usage," . In order to get the fix, however, users have to download the update, which is not yet available.

Faulty Chargers

Issue: Users were , complaining that the new phone wasn't charging that well (a problem that seems to creep up a lot in iPhone land). "My iPhone 5 will not charge has anyone else got this problem? When I plug the lightning cable in its as if the phone registers this but it will not charge. I am also unable to transfer any data across to the phone," .

Fix: Nothing official from Apple, yet. But, it sounds like there are two separate problems here with the same not-quite-ideal solution. Some are complaining of faulty lightning cords while others are mentioning broken adapters for said cords. Beyond the somewhat janky solution below, the best solution users have found leads to buying a new charger altogether.

Defective Hardware: Rattles and Leaks

Issue: We've seen two defects in the phone parts department. Some have complained of a and others have reported leaking light through the top of the screen, as pictured right. 
Fix: Apple forums complainers have attributed the rattling to a loose battery. "Just back from my Genius Bar appoint at the Apple Store at the Falls, Miami. Loose battery.  Adhesive reapplied to the battery. No more rattle. Took less than 5 minutes and sent me on my way," . Though, others have mentioned the camera lens or the vibrating mechanism. As for the light problem, it the only solution is to deal with it, or get a replacement from the Apple store.
